1. Introduction

1.1. Definitions of terms and expressions used in this contract:

User : natural person using the Tradition Casino software, its website and /or service.

1.2.1. This user contract (hereby called “the Contract”) is between the user and Tradition Casino. 2. Purpose of the contract

4.1.9. The user accepts the obligation not to use any software or device able to modify, for their own benefit and/or the benefit of a third party, the use of Tradition Casino services. The user recognizes that Tradition Casino is the only judge in the matter if a doubt were to occur. Thus, in order to prevent fraud, Tradition Casino has the right to claim a copy of an identity card, an electricity bill, a phone bill, both sides of a credit card, bank statements and more. Lastly, Tradition Casino is also authorized to require a signature of the user for each deposit carried out by them.
If the user uses an electronic portfolio such as Click2Pay, MoneyBookers, Neteller and Ecocard, Tradition Casino will have also the right to require a proof of deposit carried out on the aforementioned electronic portfolio.

4.1.15. The user accepts the fact that in case of profits exceeding 10.000 €/£/$, their name and photograph can be spread by any medium chosen by Tradition Casino: TV, radio, mailing lists, Internet websites, postal mail, etc. This permanent and irrevocable right of diffusion is a valid exclusive worldwide right. This right aims to help Tradition Casino’s commercial interests as well as any company elected by Tradition Casino in order to pursue this goal.

5. Commitments

5.1. Tradition Casino is a casino owned and operated by Silverstone Overseas Limited, Ingles Manor, Castle Hill Avenue, Kent, Folkestone, United Kingdom (hereafter “Silverstone”) a company wholly owned by Bonne Chance NV (hereafter “BC”). Bonne Chance NV is a company incorporated, licensed and regulated by the Government of Curacao for the purpose of operating an online casino. This company has all the authorizations necessary to practice its business, according to Curaçao laws, autonomous territory of the Kingdom of the Nether lands. These authorizations confer the right to exploit an online casino referred to as Tradition Casino by means of an Internet broadcasted software.

5.2. In accordance with the terms and conditions defined in this contract and via Bonne Chance NV, Tradition Casino commits to carry out all payments of all profits obtained by the user.

5.3. Tradition Casino will not be held responsible for the omission, loss or theft of users connection information. Consequently, Tradition Casino will not be brought before the courts in case of the possible illicit use of information, whether the nature of this information is the user’s identifier, password or email account used during registration to Tradition Casino. Thus, any unauthorized access to a user account and/or any transaction rising from this illicit use could not be disputed by the user and will be under their own responsibility.

5.4. Tradition Casino will not be held responsible for the user’s omission or loss connection information, even following an error of Tradition Casino. Tradition Casino is by no means obliged to preserve the identifiers and the passwords of the website, service and/or software users.

6. Conditions of all bonuses

6.1.The bonuses of Tradition Casino are the subject of specific terms and conditions specific:

6.1.2. 6.1.14. If users obtain a price and wish to perceive the value of this price in casino credits, Tradition Casino will favourably give effect to the request.

6.1.15. If users obtain a price and it is out-of-stock and/or if the delivery proves to be impossible in the home country of the user, Tradition Casino commits to credit the player account with casino credits of a corresponding amount.

6.1.16. In addition to articles 6.1.14. And 6.1.15., it is useful to specify that the value of the price will be defined according to the open commercial value of the aforesaid price.

6.2. Conditions of profits withdrawal

6.2.1. Unless otherwise advised and although the gained and cashable sums are without limits, Tradition Casino fixes a monthly maximum limit of $/£/€ 10000 withdrawal. If a user carries out a request for withdrawal higher than this limit, they will perceive their profit monthly, this until the total payment of the profit. This condition does not apply to the sums obtained with progressive jackpots.

In any case, and whatever the amount of the withdrawal, each profit is subjected to the acceptance of Tradition Casino, and the user will have to communicate to Tradition Casino all documents and proofs that the latter will judge necessary, otherwise it will cancel the aforesaid profit.

6.2.7. In addition to the maximum monthly limit of withdrawal, certain bonuses offered by Tradition Casino have a minimum amount of withdrawal and a maximum amount limit of withdrawal. 9.3. Transactions and operations carried out with Tradition Casino

9.3.1. Promotions, no deposit bonuses and other offers, in addition to the welcome offers, can be used by the user only if the last transaction recorded by Tradition Casino is a deposit. In case the last transaction of the user is a withdrawal or a no deposit offer, if a new no deposit bonus is granted, Tradition Casino maintains the right to consider that last no deposit bonus has been granted by error and, in a retroactive way, will cancel the aforementioned bonus, and all the possible profits will be regarded as being null and void.

If a user cancels a request for withdrawal, the sum Re-credited on the account is not regarded as a deposit and cannot thus be subjected to the attribution of a no deposit bonus, except special mention of the casino to the user.

9.3.2. Tradition Casino, can, to its own discretion, block the account of a user and any promotional offers.

9.3.3. The user cannot in any case reverse or refuse a payment to the profit of the casino. Tradition Casino maintains the right to close or suspend the account of the user if the latter tries to break the present clause. Accordingly, the casino will be able to make impossible any request for bonuses on the account of the user.

9.3.4. The transactions of deposit or withdrawal carried out on Tradition Casino can be subjected to bank charges and these bank charges will be the exclusive responsibility of the user, whatever the method of payment used.

10. Cashing of the profits

10.1. The minimum sum to be withdrawn from the casino by the user is 25 $/£/€. On the other hand, if the user wishes to close his player account and that the balance of payments comprise a credit lower than 25 $/£/€, the user must inform Tradition Casino by email so that it can proceed nevertheless to the transaction of payment of the remaining balance and the permanent closure of the account.

10.2. In order to receive his profits, the user must go to the casino bank and click on the corresponding heading named “Withdrawal”. The balance of the user will thus be modified immediately and the withdrawal will have a status called “On standby”. This status“On standby” is fixed at 48 hours, except week-end. This time is fixed, irrevocable and nonnegotiable with the casino.

As long as the withdrawal is on standby, the user can cancel his request for withdrawal and re-credit his balance with the corresponding sum. During these 48 hours, and like detailed in article 10.5. of these terms and conditions, the casino maintains the right to study the request for withdrawal and to claim possible documents related to the user account as well as the means of payment used by the user.

Beyond the 48H, the casino proceeds to the phase “payment of the profit” as explained in paragraph 10.3.

10.3. The payments of profits will be carried out after the withdrawal period of 48 hours described in article 10.2 following the acceptance by Tradition Casino financial services concerning the request for withdrawal made by the user.

Nevertheless, the user must wait a few more days in order to perceive on his bank account the sum corresponding to his request for withdrawal. This additional time does not depend on Tradition Casino, and can vary according to the method of withdrawal chosen by the user.

10.4. No request for withdrawal can be treated and accepted by Tradition Casino if the personal information communicated during the creation of the account does not coincide perfectly with information relating to the means of payments used in the casino and/or being used for the withdrawal. The requests for withdrawal will have, in addition, to be the initiative of the user and the payments of profits will be systematically subjected to the preliminary acceptance of Tradition casino.

10.5. The requests for withdrawal cannot be validated if the user does not cooperate with Tradition Casino and refuses to provide the documents the casino maintains the right to ask before carrying out any withdrawal, this with an aim of making sure of the identity of the user and the property of the means of payment used by the latter.

Consequently, Tradition Casino grants the right to require documents such as: front and back copy of the credit card used by the user, front and back copies of proof of identity (identity card, passport), front and back copy of proof of residence (telephone invoice, electricity bill, water-company invoices), front and back copy of a bank statement and/or a bank account number, etc. In addition, could also be requested from the user a signature with dimensions of each transaction of deposit carried out in the casino.

If the user refuses to yield this clause, Tradition Casino maintains the right to suspend and/or cancel all transactions on the aforementioned account, whether they are deposits, refunds, match bonuses, no deposit bonus, free conceded sums, free Casino credits, payments of profits or all similar amounts.
Moreover, the user should not have any unpaid sums due to Tradition Casino on the day of the request for withdrawal, this condition is strictly obligatory so that the casino carries out the payment of the profits.

10.6. Documents quoted in the paragraph 10.5 must be provided by the user within a specified time slot. Nevertheless, Tradition Casino makes a point of recalling that in the case of a request for withdrawal, the user will have 3 working days only to provide by email the documents claimed by Tradition Casino, then from the documents reception date by email, Tradition Casino can require up to two working days to examine, validate the documents sent and confirm with the user his approval on the reliability of the aforesaid documents.

If Tradition casino does not have time to approve the documents sent by the user of a payment of profits, the sum of the profit will then be credited on the account so that the user can proceed to a new request for withdrawal.

10.7.Concerning all withdrawals request earned with any bonuses, documents quoted in the paragraph 10.5 must be provided by the user within a specified time slot : 30 days maximum. If not, winnings will be cancelled and will be removed from account.

10.8. Bank charges imposed during withdrawals, such as emission of cheque, ACH, payment by Neteller, Click2Pay, MoneyBookers, Ecocard or any other electronic portfolio, will directly be debited from the user’s profits.

These expenses are inherent to the will of Tradition Casino and can be related to monetary conversions or the home country of the user.

11. Exclusion of guarantee

11.1. The service and the software are provided as new. We do not give any guarantee nor make any statement, explicit or implicit, about the satisfactory quality, the adequacy with the object, the exhaustiveness or the exactitude of the service or the software.

11.2. Tradition Casino will not be held responsible for the possible data-processing dysfunctions, failures of services of the companies of telecommunications or Internet connections. In the same way, Tradition Casino will not be responsible for the attempts deployed by the user to take part in the games via methods, software, means or routes transportation not envisaged by the software.

11.3. Tradition Casino does not guarantee that its service is free from any failure, but commits on the other hand, within an adequate time frame, to correct the possible failures which the users can indicate by writing to support@tradition-casino.com.

11.4. In spite of its technicality and its goodwill, Tradition Casino can only guarantee to its users that the Tradition Casino website, game software and associated files do not comprise any virus. It is up to each user to protect their computer and its operating system with effective antivirus and firewall.

No complaint can be made by a user in the event of losses, damage or any other type of incidents related to the presence of a virus in any part of our website or software.

11.5. Tradition Casino is by no means responsible to ensure totality or part of its service 24H/24 and 7J/7. The casino thus maintains the right to constantly suspend part of its service, even the whole of its service, to its own discretion and without obligation to inform its users beforehand. Hence, Tradition Casino cannot be accused of such a suspension of service but will nevertheless restore the totality of its service within a reasonable time as soon as possible and if the technical or legal context allows so.

11.6. In case the Tradition Casino game software were subject to dysfunction, all the bets would be regarded as null and void. Tradition Casino cannot be held responsible for the losses or other nuisances which would rise from a dysfunction, whichever it might be.

11.7. Tradition Casino does not guarantee that the service and the software are in conformity with the laws of the country of the user, sufficiently reliable and protected, free from any error or defect, free from obligatory or minor updates, free of bugs or instability of any kind. 11.8. In addition to article 4.1.18., Tradition Casino makes a point of specifying that it cannot be held responsible for the acts, refusal or omissions emanating from a third party such as internet access suppliers, or from any other third party, having to convey any connection giving access to our service and/or our website. The user is solely responsible for the contracts which they concluded with such third parties and the possible litigations with these third parties cannot affect the obligations of the user with respect to this present contract.

12. Amendment

12.1. Tradition Casino can at any time and without preliminary opinion modify, remove, insert or add to the present general Conditions, of the specific conditions related to one of the clauses of this contract, a promotion, a contest or its rules.

12.2. These modifications will be effective immediately after their publication to the Website.

12.3. The user properly commits to consult the casino’s terms and conditions regularly, the terms to each promotion in progress or future promotions, the conditions of specific contests and the Terms and conditions of each game rules.

13. Compensation, limit of responsibility and unliability

13.1. The user admits to have willingly and freely chosen and used the Service and the Software at their own risks.

13.2. Tradition Casino cannot be held responsible for direct or indirect losses or damage, undergone by the user or a third party, following the use of the service, website and/or software.

The exhaustive list of losses and damage include commercial losses, financial losses, losses of commercial or private information, lower standards of living, divorces, suicide as well as any other consecutive type of loss to those previously quoted.

13.3. Tradition Casino cannot be held responsible for the losses and damage undergone by the user following a discontinuation, provisional suspension and or/modification of the service and/or software.

13.4. Tradition casino cannot be held responsible for financial or non financial losses resulting from a service dysfunction and/or software rising from a delay, an absence or a corruption of the data related to a dysfunction of the lines of communication, with an error or omission inherent in our will, with a malevolent use of our website, even with a hacking of our service and/or our software.

On the assumption that these situations would result from a profit perceived on the account of the user, Tradition Casino maintains the right to claim the aforementioned profit, even if the sum is already cashed, and the user commits to refund the casino of the above mentioned profit immediately.

In the event of litigation, Tradition Casino will be able, to its own discretion, to directly deduce the sum due from the balance of the user, if the latter have enough credits allowing such a refund.

13.5. The user deliberately accepts to compensate and guarantee Tradition Casino, the whole of his leaders and administrators, associates and other agents, subsidiary companies and head offices against all expenditure, damages, various costs of direct or indirect nature, accessories or paramount, punitive or other, following the use of the Tradition Casino website, its service and/or its game software.

The nature of this use includes the following points, among others:

- visit, use or re-use of this website;
- use or re-use of all software or files coming from this website, or obtained from any other source or support;
- checking, use or re-use of this website’s host server;
- ability to carry out a deposit on the user’s player account;
- action of betting or playing on Tradition Casino;
- acceptance and use of any profit, bonuses, no deposit bonus, promotion or any other prize offered by the Casino;

13.6. 14. Violation of the terms and conditions

By the acceptance of this Contract, users commit themselves to compensate Tradition Casino completely, defend Tradition Casino as well as exonerate it, if necessary, of an unspecified complaint, responsibility, expenditure or cost, expenses of all natures, resulting from the rupture of this contract, violation of one of our terms and conditions, non respect of our rights, use of the Service and/or software with your personal identifiers with or without your agreement as well as any acceptance of profit on behalf of the user.

14.2. If the user has exceeded his rights and has not respected one of the terms of this contract, Tradition casino maintains the absolute right to block the user account and to confiscate the account credits in order to compensate itself for the undergone damage, or even recover the sums owed by the user.

The casino will also be able, if the situation allows it, to prohibit the access to the site and/or the software, or to launch an enquiry on the user, if they were found guilty of infringement of these terms and conditions.

15. Resolution of the conflicts

15.1. If the result exposed in the software does not correspond to the result obtained via our server, the results delivered by our server is the authentic result, which the user recognizes and accepts.

The user also accepts the fact that Tradition Casino Random numbers Generating Software of (RNG: Random Number Generator) and that the purpose of this software is to provide the game server with a sufficient quantity of random numbers necessary to gambling .

15.2. If the user wishes to dispute a transaction carried out in the casino, they have a 7 working days deadline starting on the date of the aforementioned transaction to inform Tradition Casino of it.

If this deadline is not respected, the request will not be taken into account, and will be considered null and void.

15.3. This contract was initialized, designed and written in French. In the event of litigation or bad formulation in the other languages following a bad translation, the contract written in French is the authentic text that will prevail.

16. Duration and cancellation

16.1. This contract takes effect immediately after the user starts participating to the casino actions. This participation can take various forms among which: registration to the casino, remote loading of the game software, use of the flash version and/or java version of the casino, deposit and/or withdrawal of profits.

The contract remains active until it is cancelled in agreement with the terms contained in the aforementioned contract.

16.2. The user can ask to cease the effects of this contract by formulating his request in an email to Tradition Casino and the request for cancellation will be accepted by Tradition Casino if the user can justify having no unpaid sums.

The cancellation of this contract hence implies that the user can no longer use Tradition Casino’s service or software.

16.3. If a user account remains inactive for 6 months or more, Tradition Casino maintains the absolute right to monthly withdraw 30 credits off the player account concerned and definitively to close the account at the end of 12 consecutive months inactivity.

If credits still remain on the account, these credits will systematically be credited to the user’s bank account, in accordance with information that the user will have provided at the time of their registration or their last account update.

16.4. Tradition Casino can at any time and without preliminary notification, close a user account provided the user has broken one of the clauses of the contract, or if Tradition Casino judges that the user devotes himself to an abusive use of the software and/or service, which is included/understood but does not limit itself to the fraud of these terms.

16.5. In the case of an anticipated cancellation of this emanating contract of Tradition Casino or of the user, the casino will pay the remaining sums of credits on the user account to the user’s bank account, after deduction of any amount due to Tradition Casino, provided the user owes it to the casino.

16.6. In the case of an anticipated cancellation of this contract, none of the parties will preserve any obligation, except contrary stipulation and subject to the rights and obligations agreed and accepted before the cancellation of the aforesaid contract.

17. Applicable rights and competence

17.1. This contract, its interpretation and its execution, like all legal relations between the parties resulting from this Contract, must be controlled and interpreted in conformity with the law of the Netherlands.

The validity, the interpretation and the execution of this Contract, are subjected to the nonexclusive competence of the courts of first authority of the Netherlands, which the two parties formally accept.

17.3. Any direct or indirect litigation resulting from this contract will have to be treated by the qualified Court of Justice located at the Netherlands, only by applying the legal remedy traditionally aiming at resolving such litigations.

Tradition Casino nevertheless maintains the right to bring any legal proceedings towards a user, before any qualified Court of Justice.

18. Intellectual property

18.1. Via this contract, Tradition Casino grants the user a revocable, nonexclusive and non transferable right, which consists in using the website of the casino, its software and/or its service as well as all linked services. This right also extends to the royalties and all the rights of intellectual ownership being attached to it.

18.2. The user recognizes and accepts that the copyright, the mark and all other rights of intellectual ownership being exerted on any material and/or provided contents and belonging to the website and/or the software of casino, remain our strict property. The user can use the above mentioned material only in agreement with these terms and conditions.

18.3. The user recognizes and accepts the fact that the material and the contents reproduced on the website of the casino are placed at their disposal only as non commercial titles. This material and these contents should be downloaded on the hard disk of a computer only to serve this goal.

Any other use is strictly prohibited as well as the copy, falsification, the reproduction, the publication, the transmission and the distribution of work derived from this material and these contents.

This contract is regarded as duly signed and accepted by the two parties, that is to say between Tradition Casino and the user.

The date of entry of this contract corresponds precisely to the date where the user makes use of Tradition Casino according to terms described in article 13.5.
